2ndOpinion complies with the new GDPR or General Data Protection Regulation, pursuant to Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of that data. This new legislation largely protects the personal data of European citizens. This makes the control over how we may use your personal data clearer and simpler.

Your privacy right includes the ability to request, forward, modify or delete all personal data that 2ndOpinion has available. You can also request a restriction on the processing or make an objection to the general processing of your personal data.

Data file: the digital file, compiled and updated by 2ndOpinion, which consists of all the Personal Data communicated to it;
2ndOpinion: 2ndOpinion bvba, with registered office at 3070 Kortenberg, Kiewitstraat 111, and incorporated in the Crossroads Bank for Enterprises with the number 0691.840.721;
Personal data: all information on the basis of which you can be identified or on the basis of which you are identifiable, such as name, identification number, location data, an online identifier or one or more elements that are characteristic of the physical, physiological, genetic, psychological, economic, cultural or social identity of your person.
Service: all services for which you have contracted 2ndOpinion; 
Processing: the processing of Personal Data as described under the definition of Processing;
Processing: an operation or a whole of operations relating to Personal Data or a set of Personal Data, whether or not performed via automated processes, such as collecting, recording, organizing, structuring, storing, updating or modifying, retrieving, consulting, using, providing by means of forwarding, distributing or otherwise making available, aligning or combining, protecting, deleting or destroying data.
2ndOpinion is responsible for the Processing of your Personal Data.

2. What Personal Data do we collect?
2ndOpinion collects the Personal Data that you provide us with, regardless of the way in which (via the answer form on this website). You are entirely free to inform 2ndOpinion of your Personal Data or not. Please note that the conclusion of an agreement and the delivery of our Service may be refused if you do not communicate your Personal Data to 2ndOpinion. You are solely responsible for the accuracy of the data that you communicate to 2ndOpinion. In addition, 2ndOpinion automatically collects certain Personal Data via cookies. 3. Processing of your Personal Data
a) The Processing in the context of the execution of the agreement
2ndOpinion Processes your Personal Data exclusively within the framework of the Service (s) for which you cont(r)acted 2ndOpinion. 2ndOpinion Processes your Personal Data exclusively for entering into and following up our mutual commercial relationship.
b) The Processing based on your consent
By agreeing to this privacy statement, you also consent to 2ndOpinion to Process the Personal Data you have communicated for the use of a Service for the following purposes: if you use a 2ndOpinion Service and leave your details, 2ndOpinion can automatically keep you informed of news via a newsletter; research to improve the quality of our services; after having made the Personal Data anonymous, to compile statistics in order to build up substantive knowledge.
If 2ndOpinion decides to execute a Processing of your Personal Data for a purpose that is not provided for in this privacy statement, it will contact you at the e-mail address provided by you in order to inform you of this new Processing and its purpose, where you have the possibility to refuse this Processing.

4. Confidentiality
The Personal Data will be kept strictly confidential and will in no case be communicated to third parties, unless 2ndOpinion has obtained your explicit prior consent.

5. The withdrawal of your consent
You can withdraw your consent to the Processing of your Personal Data at any time. Such withdrawal of your consent does not affect the Processing that takes place in the context of the execution of your agreement with 2ndOpinion, nor the legality of the Processes that already occurred on the basis of your consent before it was withdrawn.

6. Duration of keeping the Personal Data
With respect to the Services of 2ndOpinion, your Personal Data will be stored for a period necessary for 2ndOpinion to achieve the purpose of the Processing or to fulfill its contractual obligations. This period ends five years after the last day of the month in which you last left your data with 2ndOpinion, or you have written out on the newsletter, except for special legal provisions that provide for a shorter duration.

7. Right of access, improvement and data exchange
You have the right to request 2ndOpinion to inspect your Personal Data, the correction of incorrect or incomplete Personal Data or the erasure thereof. Such erasure of Personal Data is not possible if the Processing of your Personal Data is necessary for the realization or the execution of the agreement between you and 2ndOpinion or for the exercise or substantiation of or the defense in the context of a legal claim.

8. Limitation of Processing
In certain cases you have the right to obtain the restriction of the Processing. This is the case if you dispute the accuracy of the Personal Data, if the Processing is unlawful, if you object to the deletion of the Personal Data, or if you need the Personal Data for the establishment, exercise or substantiation of a legal claim while 2ndOpinion no longer needs the Personal Data for processing purposes. 2ndOpinion will only store your Personal Data in such a case.

9. Transferability of Personal Data
You have the right to obtain the Personal Data relating to you and which you have provided to 2ndOpinion or to transfer that Personal Data. Such acquisition or transfer is not possible if the Processing of your Personal Data is necessary for the realization or execution of the agreement between you and 2ndOpinion or for the exercise or substantiation of or the defense in the context of a legal claim.

10. Automated decision-making
You have the right not to be subject to a decision based solely on automated processing if this has legal consequences for you or this affects you to a considerable extent. This is not possible if this decision is necessary for the realization or the execution of the agreement between you and 2ndOpinion or when this decision is based on your permission.

11. Exercising your rights
You can exercise the rights of this privacy statement by submitting a dated, written or electronic request with a copy of your identity card to 2ndOpinion or, if applicable, providing a supplementary statement.

12. Safety
2ndOpinion has developed security measures that are technical and organizational adapted to the destruction, loss, falsification, modification, unauthorized access or notification by mistake to third parties of your Personal Information collected on the website (and on any other manner) as well as any other unauthorized Processing of your Personal Data. Under no circumstances can 2ndOpinion be held responsible for any direct or indirect damage resulting from incorrect or unlawful use by a third party of your Personal Data. 2ndOpinion is not responsible for the content of third-party websites to which it refers in its website, nor for the products or services mentioned on it.
